Definitions
The following terms have the meanings assigned to them below throughout these Terms:
"Customer" means a user who registers to find and book party services.
"Service Provider" or "Provider" means a user who registers to list and offer party-related services.
"Service" means any party-related offering listed on the Platform, including venues, catering, DJ and music, décor, entertainment, photography, bar services, and security.
"Booking" means a confirmed reservation between a Customer and Provider made through the Platform.
"Platform Fee" means the 10% commission deducted from the Provider's payout on each completed Booking.
"Payout" means the net amount transferred to a Provider after deduction of the Platform Fee.
"Credit" means PartyLink platform credit issued to a Customer following a qualifying cancellation, redeemable against future Bookings.
"Content" means any text, images, videos, reviews, descriptions or other material uploaded to the Platform.
"POPIA" means the Protection of Personal Information Act 4 of 2013.
"CPA" means the Consumer Protection Act 68 of 2008.
"ECTA" means the Electronic Communications and Transactions Act 25 of 2002.
Eligibility
2.1 You must be at least 18 years of age to use the Platform.
2.2 By using the Platform, you represent and warrant that you are legally capable of entering into binding contracts under South African law.
2.3 You may not use the Platform if you have previously been suspended or permanently banned from PartyLink.
2.4 If you are registering on behalf of a business or legal entity, you warrant that you have authority to bind that entity to these Terms.
Account Registration and Security
3.1 You must provide accurate, current, and complete information during registration and keep your account information updated at all times.
3.2 You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
3.3 You must notify PartyLink immediately at support@partylink.co.za if you suspect any unauthorised access to your account.
3.4 PartyLink reserves the right to refuse registration or cancel accounts at its discretion, including where information provided is found to be inaccurate, false, or misleading.
3.5 You may not create more than one account per user role without prior written consent from PartyLink.
The Platform — Nature of Service
4.1 PartyLink is an online marketplace that connects Customers seeking party services with independent Service Providers.
4.2 PartyLink does not itself provide any party services. We are not a party to the service agreement between Customers and Providers, except to the extent expressly set out in these Terms.
4.3 PartyLink does not employ, endorse, or guarantee the quality, safety, legality, or suitability of any Provider or Service listed on the Platform.
4.4 PartyLink acts as a payment facilitator and booking intermediary only.
Prohibited Conduct
The following conduct is strictly prohibited on or in connection with the Platform:
- Circumventing the Platform's booking or payment systems by arranging or accepting payment for services directly with another user discovered through the Platform, including sharing contact details for the purpose of off-platform transactions.
- Using another user's personal information for any purpose other than that which is permitted under these Terms.
- Posting false, misleading, defamatory, discriminatory, harassing, abusive, obscene, or unlawful Content.
- Attempting to gain unauthorised access to the Platform, other users' accounts, or PartyLink's systems.
- Scraping, crawling, or otherwise extracting data from the Platform by automated means without express written permission.
- Reverse engineering, decompiling, or attempting to extract the source code of the Platform.
- Using the Platform to engage in any fraudulent, deceptive, or illegal activity.
- Uploading or transmitting viruses, malicious code, or any material that disrupts the Platform's functionality.
- Impersonating another person or entity, or misrepresenting your affiliation with any person or entity.
- Engaging in price manipulation, fake reviews, or any conduct designed to artificially inflate or misrepresent a Provider's reputation.
Breach of any of the above may result in immediate account suspension or termination, and may be referred to relevant law enforcement authorities.
Content Rules
6.1 You retain ownership of Content you upload to the Platform but grant PartyLink a non-exclusive, royalty-free, worldwide, perpetual licence to use, display, reproduce, and adapt your Content for the purposes of operating and promoting the Platform.
6.2 PartyLink reserves the right to remove any Content that violates these Terms or that we consider, in our sole discretion, to be inappropriate, harmful, or misleading.
6.3 You warrant that any Content you upload does not infringe the intellectual property rights of any third party.
6.4 Reviews must be based on genuine first-hand experience. Fake, incentivised, or malicious reviews are prohibited and may result in account suspension.
Intellectual Property
7.1 The PartyLink name, logo, platform design, software, and all associated intellectual property are owned by or licensed to PartyLink (Pty) Ltd. Nothing in these Terms grants you any right to use our intellectual property without prior written consent.
7.2 You may not use PartyLink's branding, trademarks, or platform elements in any way that suggests endorsement or affiliation without explicit written permission.
Privacy and Data Protection (POPIA Compliance)
8.1 PartyLink processes personal information in accordance with POPIA and our Privacy Policy, which is incorporated into these Terms by reference.
8.2 By using the Platform, you consent to the collection, processing, and storage of your personal information as described in our Privacy Policy.
8.3 You have the right to access, correct, or request deletion of your personal information by contacting us at privacy@partylink.co.za.
8.4 PartyLink will not sell your personal information to third parties.
8.5 PartyLink implements reasonable technical and organisational measures to protect personal information against loss, unauthorised access, or unlawful processing.
8.6 In the event of a data breach that poses a risk to your rights, PartyLink will notify you and the Information Regulator as required by POPIA.
8.7 Service Providers who access Customer personal information through the Platform must handle such information responsibly and only for the purpose of fulfilling the Booking. Providers may not use Customer information for marketing or any other purpose not directly related to service delivery.
Electronic Communications and Contracts (ECTA Compliance)
9.1 In accordance with ECTA, you agree that any booking, agreement, or acceptance made through the Platform constitutes a valid and legally binding electronic transaction.
9.2 PartyLink will provide you with a record of your transactions and bookings accessible through your account dashboard.
9.3 Communications sent by PartyLink to your registered email address constitute effective delivery of notices under these Terms.
Dispute Resolution Between Users
10.1 If a dispute arises between a Customer and a Service Provider regarding a Booking, the parties should first attempt to resolve the matter directly through the Platform's messaging system.
10.2 If the dispute cannot be resolved within 48 hours, either party may escalate the matter to PartyLink by emailing disputes@partylink.co.za with full details and supporting evidence.
10.3 PartyLink will review escalated disputes and may, in its sole discretion, make a determination regarding refunds, credits, or other remedies. PartyLink's decision is final with respect to Platform Credits but does not affect any legal rights either party may have under applicable law.
10.4 PartyLink is not obligated to mediate or resolve disputes between users but may do so at its discretion.
Force Majeure and Extraordinary Events
11.1 Neither party shall be liable for failure to perform their obligations due to events beyond their reasonable control, including but not limited to natural disasters, acts of government, civil unrest, pandemic, or other force majeure events (“Extraordinary Events”).
11.2 If an Extraordinary Event prevents a Provider from delivering a confirmed Service, the Provider must notify both the Customer and PartyLink as soon as reasonably practicable.
11.3 In cases of verified Extraordinary Events, PartyLink may, at its discretion, issue the Customer full Platform Credit equivalent to the amount paid, with no penalty to the Provider.
Limitation of Liability
12.1 To the maximum extent permitted by applicable law, PartyLink shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
12.2 PartyLink's total aggregate liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the total amount you paid through the Platform in the 6 months preceding the event giving rise to the claim.
12.3 PartyLink is not liable for the acts or omissions of any Service Provider, including but not limited to failure to deliver a Service, property damage caused by a Provider or Customer, or injury arising from a Service.
12.4 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under South African law.
Indemnification
You agree to indemnify, defend, and hold harmless PartyLink (Pty) Ltd, its directors, employees, agents, and partners from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- (a) your use or misuse of the Platform;
- (b) your breach of these Terms;
- (c) your Content;
- (d) your interactions with other users of the Platform; or
- (e) your violation of any applicable law or third-party rights.
Modifications to Terms
14.1 PartyLink reserves the right to update or modify these Terms at any time. Material changes will be communicated by email to your registered address and/or by a prominent notice on the Platform.
14.2 Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms.
14.3 If you do not agree to the revised Terms, you must discontinue use of the Platform and close your account.
Termination and Suspension
15.1 PartyLink may suspend or terminate your account at any time for any violation of these Terms, fraudulent activity, or behaviour that PartyLink reasonably believes poses a risk to other users or the Platform.
15.2 You may close your account at any time by contacting support@partylink.co.za. Closure does not affect any outstanding Bookings, obligations, or liabilities.
15.3 Upon termination, your right to access the Platform ceases immediately. PartyLink may retain certain information as required by law or for legitimate business purposes.
Governing Law and Jurisdiction
16.1 These Terms are governed by the laws of the Republic of South Africa.
16.2 Any disputes arising from these Terms that cannot be resolved amicably shall be subject to the jurisdiction of the South African courts, specifically the courts of Gauteng, unless otherwise agreed.
Booking Process
17.1 Customers initiate Bookings by selecting a Service, completing the booking form (including event date, time, duration, guest count, and service address), and confirming payment through the Platform.
17.2 A Booking is confirmed only once the Customer has received a booking confirmation with a reference number via email and on the Platform.
17.3 Customers are responsible for providing accurate event details, including the correct venue address, access instructions, and any special requirements.
17.4 Customers must ensure the event location is safe, legally accessible, and suitable for the Provider to deliver their service.
17.5 PartyLink does not guarantee that a Provider will accept a Booking request. Providers may decline at their discretion.
Pricing and Payment
18.1 The price displayed on each Service listing is the final amount the Customer pays. There are no additional fees or surcharges added at checkout by PartyLink.
18.2 Payment is processed securely through the Platform at the time of Booking confirmation.
18.3 Customers do not pay any Platform service fee — the full listed price is what the Customer pays.
Cancellations and Refunds (Customers)
19.1 Customers may cancel a Booking at any time through their account dashboard.
19.3 Cancellation of a Pending Booking (not yet confirmed by Provider): Full refund issued to the original payment method within 5–7 business days.
19.4 Cancellation of a Confirmed Booking (after Provider has confirmed): The Customer will receive Platform Credit equal to the full Booking amount. No cash refunds are issued for confirmed Bookings outside of the cooling-off period.
19.5 Platform Credit has no cash value, is non-transferable, and expires 12 months from the date of issue.
19.6 PartyLink reserves the right to review cancellation requests and may withhold Credit in cases of suspected abuse of the cancellation policy.
Use of Platform Credit
20.1 Platform Credit can be applied at checkout to reduce or fully cover the cost of future Bookings.
20.2 If the Booking value exceeds available Credit, the Customer may pay the balance through the standard payment method.
20.3 Customers may choose to pay the full Booking amount without using their Credit. Credit will not be applied unless the Customer elects to do so at checkout.
20.4 Credit is not redeemable for cash under any circumstances.
Customer Responsibilities
21.1 Customers must treat Service Providers with respect and professionalism at all times.
21.2 Customers are responsible for any damage caused to a Provider's equipment or property by the Customer, their guests, or attendees at the event.
21.3 If a Provider reports property damage or loss, PartyLink may facilitate a resolution process and may recover documented costs from the Customer.
21.4 Customers must not record, photograph, or livestream Providers without their consent.
Reviews (Customers)
22.1 Customers may submit one review per completed Booking.
22.2 Reviews must reflect honest, first-hand experience of the Service received.
22.3 Reviews may include a star rating (1–5) and optional written comment of up to 500 characters.
22.4 PartyLink reserves the right to remove reviews that are found to be fake, incentivised, abusive, defamatory, or in violation of these Terms.
Provider Registration and Listings
23.1 Providers must provide accurate and complete information about their business, services, pricing, availability, and qualifications.
23.2 Providers are solely responsible for ensuring their service listings are accurate, up to date, and not misleading.
23.3 PartyLink reserves the right to review, edit, or remove any listing that violates these Terms or that PartyLink considers inaccurate or inappropriate.
23.4 Providers must not list services they are not qualified, licensed, or equipped to deliver.
23.5 Providers may not include in their listings any external website URLs, social media handles, personal email addresses, or phone numbers that could be used to facilitate off-platform transactions.
Platform Fee and Payouts
Example: If a Service is listed at R10,000, the Provider receives R9,000 and PartyLink retains R1,000.
24.2 The Platform Fee is deducted automatically before Payout. Providers receive 90% of the listed Service price.
24.3 For hourly-rate Services, the Platform Fee applies to the total booking amount (hourly rate × number of hours).
24.4 Payouts are released 24 hours after the confirmed service delivery date. Payout for cancelled Bookings will not be released.
24.5 PartyLink reserves the right to withhold or reverse a Payout in cases of verified fraud, Customer complaints, or unresolved disputes.
24.6 The Platform Fee may be revised by PartyLink. Providers will be given at least 30 days' written notice of any change to the Platform Fee.
Pricing
25.1 Providers set their own prices. PartyLink does not artificially inflate or modify prices shown to Customers.
25.2 Providers may choose between a fixed (per-event) price or an hourly rate. Both must be clearly specified in the Service listing.
25.3 Providers must honour the price listed at the time of Booking. Price changes after a Booking is confirmed are not permitted.
25.4 Prices must be listed in South African Rand (ZAR).
Off-Platform Transactions Strictly Prohibited
26.2 Providers may not share personal contact details with Customers for the purpose of arranging direct transactions.
26.3 PartyLink actively monitors for circumvention and Customers are encouraged to report any such behaviour to disputes@partylink.co.za.
Provider Cancellations
27.1 Providers should only accept Bookings they can fulfil. Frequent cancellations by Providers may result in lower search placement, suspension, or termination.
27.2 If a Provider cancels a Confirmed Booking, the Customer will receive full Platform Credit. No Payout will be issued to the Provider for that Booking.
27.3 Providers must notify both the Customer (through the Platform) and PartyLink as soon as they become aware they cannot fulfil a Booking.
Provider Responsibilities
28.1 Providers must deliver their Services professionally, safely, and to the standard described in their listing.
28.2 Providers are responsible for ensuring they hold any necessary licences, permits, or insurance required to deliver their Services legally in South Africa.
28.3 Providers are independent contractors and are not employees, agents, or partners of PartyLink. Providers are solely responsible for their own tax obligations, including VAT registration if applicable.
28.4 Providers must comply with all applicable South African laws, including health and safety regulations, in delivering their Services.
28.5 Providers must treat Customers with respect and professionalism at all times.
28.6 Providers must not record, photograph, or livestream Customers or guests without their consent.
Damage and Liability (Providers)
29.1 Providers are responsible for any damage they or their staff cause to a Customer's property during service delivery.
29.2 Providers indemnify PartyLink against any claims, losses, or liability arising from the Provider's delivery (or failure to deliver) of their Services.
29.3 PartyLink strongly recommends that all Providers obtain appropriate public liability insurance before offering services through the Platform.
Taxes
30.1 Providers are solely responsible for determining and fulfilling their tax obligations, including income tax and VAT, arising from revenue earned through the Platform.
30.2 PartyLink does not deduct or remit taxes on behalf of Providers, except as required by law.
30.3 Providers whose annual turnover exceeds R1,000,000 are reminded of their obligation to register for VAT with SARS.
